• A probate attorney or a probate lawyer must understand many things in the probate process properly, which are generally overlooked by an executor. Those things are:
1. If a will has been left behind,
2. A court is needed or not
3. If there is the need of a personal representative, who is appointed by the court.
4. Action to be taken if no will is left behind.
• Collect debts if any owed by someone towards the deceased person.
• A probate proceeding can continue for a period of four months till number of years in order to be completed. This depends on the state laws and the other varying circumstances. A probate attorney has to play his role till the probate proceeding is not complete. He has to assure that the heirs and the other rightful people get what they deserve.
• Clear all titles to stocks and bonds, loan accounts, large bank savings and land that the deceased person held in his/her name only. The probate attorney has to put the titles to all the assets left to the heirs by their names.
• A probate attorney also has to settle disputes between people who rightfully claim that they are entitled in having a part in the property of the deceased person and everything he/she has left behind.
• Probate attorney also resolves any disputes, which come up in the field of validity of the will left by the deceased person.
You can say that the job of a probate attorney is not a very easy task.
